Welcome to PothikTV.

These Terms of Service (“Terms”) govern your access to and use of PothikTV, its websites, applications, digital services, community features, publishing tools, professional services, educational services, marketplaces, artificial intelligence tools and other services operated as part of the Pothik ecosystem.

Please read these Terms carefully.

By creating an account, accessing, browsing, purchasing from, publishing on, uploading to, interacting with or otherwise using PothikTV, you agree to these Terms.

If you do not agree with these Terms, you should not use the relevant PothikTV services.

1. ABOUT POTHIKTV

PothikTV is a digital media, journalism, community, professional, education, employment, commerce and technology ecosystem operated through PothikTV Media Center and its associated services.

The Pothik ecosystem may include, where applicable:

• PothikTV.com;
• PothikNews;
• Pothik Sahitya;
• Pothik Learn;
• Pothik Work;
• Pothik Store;
• Pothik Education services;
• Pothik Verify and Fact-Check;
• Pothik AI Studio;
• Pothik Advertising;
• Pothik Account;
• mobile applications;
• Progressive Web Apps;
• institutional products;
• software;
• themes;
• plugins;
• APIs;
• professional tools; and
• other Pothik-branded products and services.

Certain products or services may have additional terms.

If additional terms apply to a particular service, those additional terms form part of your agreement with PothikTV.

If there is a conflict between these general Terms and service-specific terms, the service-specific terms will normally apply to that particular service to the extent of the conflict.

2. APPLICABLE LAW

These Terms are intended to operate in accordance with applicable laws of Bangladesh, including, where applicable:

• the Contract Act, 1872;
• the Consumer Rights Protection Act, 2009;
• the Copyright Act, 2023;
• the Personal Data Protection Act, 2026;
• the Cyber Security Act, 2026, as amended;
• applicable digital commerce guidelines;
• applicable telecommunications and payment regulations;
• applicable intellectual property laws;
• applicable criminal and civil laws; and
• lawful rules, regulations, directives and orders issued by competent authorities.

Nothing in these Terms excludes or restricts a right that cannot lawfully be excluded under applicable law.

3. ACCEPTANCE OF THESE TERMS

By using PothikTV, you confirm that:

1. you have read and understood these Terms;
2. you agree to comply with these Terms;
3. information you provide will be accurate to the best of your knowledge;
4. you will use PothikTV lawfully; and
5. you have legal capacity to enter into the relevant agreement or have appropriate permission where required.

Your use of PothikTV may also be subject to our:

• Privacy Policy;
• Community Standards;
• Refund Policy;
• Advertising Policy;
• Cookie Policy;
• Copyright Policy;
• Software Licence Terms;
• Seller Terms;
• Employer Terms;
• Mentor or Educator Terms; and
• other applicable service policies.

4. ELIGIBILITY

You may use PothikTV if you are legally permitted to use the relevant service.

Certain services may have age restrictions.

Where a child or minor uses a service designed for students or young users, parental, guardian or institutional permission may be required under applicable law.

Some services, including payments, employment services, commercial transactions, software purchases, advertising and professional verification, may be available only to users who meet additional eligibility requirements.

PothikTV may require proof of eligibility where reasonably necessary.

5. POTHIK ACCOUNT

Certain services require a Pothik Account.

A Pothik Account may provide access to multiple services through a common account or Single Sign-On system.

You may be assigned or allowed to choose:

• a username;
• a Pathik ID;
• a public profile URL;
• an email address;
• a mobile number;
• a password; and
• other account credentials.

You are responsible for maintaining accurate account information.

6. ONE PERSON, ONE AUTHENTIC IDENTITY

PothikTV may encourage or require authentic identity information for services where identity matters.

You must not:

• impersonate another person;
• create an account using another person’s identity without authority;
• deliberately misrepresent your professional identity;
• falsely claim qualifications or employment;
• create misleading verified identities; or
• use another person’s documents for verification.

Pseudonyms or professional names may be permitted in services where appropriate, provided their use is not fraudulent, misleading or unlawful.

7. ACCOUNT SECURITY

You are responsible for protecting your account.

You must:

• use a reasonably secure password;
• keep your password confidential;
• protect OTPs and authentication codes;
• avoid sharing account credentials;
• secure devices used to access your account; and
• notify PothikTV promptly if you believe your account has been compromised.

PothikTV will never require you to publicly disclose your password, PIN or OTP.

You are generally responsible for activity performed through your account unless unauthorised access occurred without your fault and applicable law provides otherwise.

8. GOOGLE AND THIRD-PARTY LOGIN

PothikTV may allow account creation or login through third-party services such as Google.

Your use of a third-party authentication provider may also be governed by that provider’s terms.

PothikTV is not responsible for interruptions caused solely by a third-party identity provider that is outside PothikTV’s reasonable control.

9. USER PROFILES

PothikTV may allow users to create personal and professional profiles containing information such as:

• name;
• photograph;
• biography;
• occupation;
• education;
• work experience;
• achievements;
• portfolio;
• skills;
• publications;
• professional history;
• social links;
• interests; and
• other voluntarily supplied information.

Users are responsible for information they choose to make public.

You must not publish another person’s private personal information without an appropriate lawful basis.

10. PUBLIC AND PRIVATE INFORMATION

PothikTV may provide visibility options such as:

• Public;
• Followers;
• Connections;
• Registered Users; or
• Only Me.

Public information may be available to anyone and may be indexed by search engines.

You should review visibility settings before publishing information.

11. USER-GENERATED CONTENT

PothikTV may allow you to publish or upload:

• text;
• news;
• articles;
• photographs;
• videos;
• audio;
• literary works;
• blogs;
• diaries;
• comments;
• reviews;
• questions;
• polls;
• job listings;
• portfolios;
• advertisements;
• courses;
• documents;
• fact-check submissions; and
• other materials.

Collectively, these are referred to as “User Content.”

You remain responsible for User Content you submit.

12. OWNERSHIP OF USER CONTENT

Subject to applicable law and any separate written agreement, you retain ownership of the intellectual property rights you have in your original User Content.

Uploading content to PothikTV does not automatically transfer ownership of your original copyright to PothikTV.

13. LICENCE TO POTHIKTV

When you upload or publish User Content, you grant PothikTV a non-exclusive, worldwide, royalty-free licence, for the period that the content remains available through the service and for reasonable backup or archival periods, to:

• host;
• store;
• reproduce;
• technically process;
• format;
• display;
• distribute through PothikTV;
• transmit;
• adapt for device compatibility;
• create previews or thumbnails;
• make content searchable;
• promote the content within PothikTV services; and
• otherwise use the content as reasonably necessary to operate the service.

This licence does not transfer ownership of your original content to PothikTV.

PothikTV will not obtain rights beyond those reasonably necessary for operating, promoting and improving the service unless you separately agree.

14. JOURNALISTIC CONTRIBUTIONS

Special rules may apply to content submitted as professional journalism, commissioned reporting, employment-based reporting or editorial assignments.

Copyright ownership may depend on:

• applicable copyright law;
• employment status;
• contributor agreement;
• commissioning agreement;
• licensing terms; or
• other written arrangements.

Where PothikTV commissions content or employs a journalist, specific editorial or employment terms may govern publication rights.

15. NEWS AND JOURNALISM

PothikTV supports journalism and public-interest reporting.

Users publishing news or journalistic content should make reasonable efforts to:

• verify material facts;
• distinguish fact from opinion;
• avoid deliberate fabrication;
• identify manipulated media where relevant;
• respect legitimate privacy interests;
• respect confidential sources;
• correct significant factual errors;
• avoid plagiarism; and
• comply with applicable law.

PothikTV may review journalistic content through an editorial workflow before or after publication.

16. EDITORIAL INDEPENDENCE

PothikTV may determine whether submitted journalistic content should be:

• approved;
• rejected;
• edited;
• corrected;
• updated;
• scheduled;
• labelled;
• fact-checked;
• archived; or
• removed.

Editorial decisions may consider:

• accuracy;
• relevance;
• public interest;
• journalistic standards;
• evidence;
• privacy;
• legality;
• safety;
• platform integrity; and
• editorial quality.

Submission of content does not guarantee publication.

17. CORRECTIONS AND UPDATES

PothikTV may correct factual, spelling, formatting or technical errors.

Where a material journalistic correction is made, PothikTV may preserve an appropriate correction record or update notice.

PothikTV may retain legitimate archival copies of published journalism where permitted by law.

18. FACT-CHECKING AND POTHIK VERIFY

Pothik Verify may allow users to submit:

• claims;
• links;
• photographs;
• video;
• documents;
• screenshots;
• statements; and
• other evidence.

Submission does not guarantee that PothikTV will investigate or publish a fact-check.

PothikTV may classify, assess, verify, reject or archive submitted claims based on editorial criteria and available evidence.

Users must not knowingly submit fabricated evidence.

19. PRIVATE MESSAGING

PothikTV may provide private messaging and communication tools.

You must not use private messaging to:

• threaten users;
• commit fraud;
• distribute malware;
• repeatedly harass another person;
• distribute unlawful intimate content;
• send illegal commercial spam;
• solicit passwords or OTPs;
• impersonate PothikTV staff; or
• facilitate illegal activities.

PothikTV may investigate reported conversations where reasonably necessary for safety, abuse prevention or legal compliance.

20. PROHIBITED CONDUCT

You must not use PothikTV to engage in unlawful or seriously harmful conduct.

Prohibited activity may include:

• unauthorised system access;
• hacking;
• credential theft;
• phishing;
• malicious code distribution;
• fraud;
• scams;
• identity theft;
• unlawful threats;
• extortion;
• exploitation;
• unlawful harassment;
• distribution of illegal content;
• deliberate infringement of intellectual property;
• manipulation of platform security;
• circumvention of account restrictions;
• fraudulent transactions;
• deceptive advertising;
• automated abuse;
• spam;
• creation of malicious fake accounts; or
• conduct prohibited by applicable law.

21. PLATFORM SECURITY

You must not:

• test security vulnerabilities without authorisation;
• bypass authentication;
• attempt unauthorised database access;
• scrape restricted personal information;
• overload servers intentionally;
• introduce malicious code;
• interfere with normal service operation;
• reverse-engineer protected systems where prohibited by law or licence;
• exploit security bugs for personal gain; or
• disclose security vulnerabilities irresponsibly.

Security issues should be reported privately to PothikTV.

22. INTELLECTUAL PROPERTY

PothikTV respects intellectual property rights.

You must not upload content that infringes another person’s:

• copyright;
• trademark;
• licence rights;
• proprietary rights; or
• other protected intellectual property.

PothikTV may remove or restrict content following a valid intellectual-property complaint.

Repeated infringement may result in account restrictions or termination.

23. POTHIKTV INTELLECTUAL PROPERTY

Except for User Content and third-party material, PothikTV’s proprietary assets may include:

• logos;
• trademarks;
• software;
• source code;
• interface designs;
• original graphics;
• platform architecture;
• databases;
• documentation;
• themes;
• plugins;
• applications;
• brand elements; and
• proprietary content.

You may not copy, sell, redistribute, modify or commercially exploit such proprietary material except as expressly authorised by PothikTV or applicable law.

24. COPYRIGHT COMPLAINTS

A person claiming copyright infringement should provide sufficient information to identify:

• the protected work;
• the allegedly infringing content;
• the location of the content;
• the claimant;
• the basis of the claim; and
• relevant supporting information.

PothikTV may request further evidence before acting.

False copyright complaints may result in appropriate action.

25. POTHIK AI STUDIO

Pothik AI Studio may provide tools for:

• drafting;
• rewriting;
• translation;
• proofreading;
• summarisation;
• headlines;
• SEO;
• captions;
• hashtags;
• interview questions;
• research assistance;
• editorial assistance;
• fact-check assistance; and
• other AI-supported functions.

AI-generated content may be inaccurate, incomplete or unsuitable.

Users are responsible for reviewing AI outputs before relying on or publishing them.

26. AI IS NOT A SUBSTITUTE FOR PROFESSIONAL JUDGMENT

Pothik AI Studio does not guarantee that AI-generated information is:

• factually correct;
• legally correct;
• medically correct;
• financially appropriate;
• original;
• complete; or
• suitable for publication.

Journalists and editors must independently verify important factual claims.

Users should obtain appropriate professional advice when necessary.

27. RESPONSIBLE USE OF AI

You must not intentionally use Pothik AI tools to facilitate:

• fraud;
• impersonation;
• malicious deception;
• cyberattacks;
• illegal surveillance;
• unlawful exploitation;
• fabricated evidence;
• infringement of another person’s rights; or
• other unlawful activity.

PothikTV may restrict access to AI services where misuse is reasonably detected.

28. POTHIK LEARN

Pothik Learn may provide:

• free courses;
• paid courses;
• lessons;
• videos;
• assessments;
• certificates;
• mentor services;
• student dashboards; and
• educational resources.

Course descriptions, prices, instructors and applicable conditions should be displayed before purchase where reasonably practicable.

29. MENTORS, TEACHERS AND COURSE CREATORS

Mentors and educators are responsible for:

• having appropriate rights to course materials;
• providing reasonably accurate course descriptions;
• complying with platform rules;
• delivering promised course material;
• respecting student privacy; and
• complying with applicable law.

PothikTV may remove a course or suspend a mentor account for serious or repeated violations.

30. EDUCATIONAL CERTIFICATES

A certificate issued through Pothik Learn confirms completion or achievement according to the requirements of the relevant course.

Unless expressly stated otherwise, a Pothik certificate does not automatically represent:

• a government qualification;
• an academic degree;
• professional licensing; or
• accreditation by a government authority.

31. POTHIK WORK

Pothik Work may provide:

• job listings;
• employer profiles;
• applications;
• professional profiles;
• freelance projects;
• proposals;
• hiring tools;
• project delivery;
• reviews;
• ratings; and
• related professional services.

PothikTV does not guarantee that a user will receive employment or freelance work.

32. EMPLOYERS AND JOB LISTINGS

Employers must not knowingly publish:

• fraudulent jobs;
• fake companies;
• misleading compensation;
• unlawful recruitment offers;
• discriminatory requirements prohibited by law;
• advance-payment scams; or
• jobs connected to illegal activity.

PothikTV may verify, reject, suspend or remove suspicious listings.

33. FREELANCE TRANSACTIONS

Where Pothik Work supports freelance transactions, applicable project terms may define:

• price;
• scope;
• deadline;
• deliverables;
• revisions;
• payment;
• fees;
• disputes; and
• refunds.

Users should maintain records of project agreements.

34. POTHIK STORE

Pothik Store may sell:

• WordPress themes;
• WordPress plugins;
• software;
• digital products;
• PDF publications;
• subscriptions;
• licence keys;
• services; and
• other products.

Product-specific descriptions and licence terms form part of the purchase agreement.

35. SOFTWARE LICENCES

Purchasing software generally provides a licence to use the software according to the applicable licence terms.

Unless expressly stated otherwise, purchasing software does not transfer:

• copyright;
• source-code ownership;
• trademarks; or
• other intellectual-property ownership.

A licence may be limited by:

• number of websites;
• number of users;
• duration;
• subscription period;
• support period;
• update period; or
• other disclosed conditions.

36. SOFTWARE UPDATES

Eligible software may receive updates according to the terms applicable at the time of purchase.

PothikTV may:

• correct bugs;
• improve security;
• add features;
• remove obsolete functionality;
• improve compatibility; or
• release new versions.

Lifetime updates apply only where expressly advertised as such.

37. SOFTWARE COMPATIBILITY

PothikTV will make reasonable efforts to describe software requirements.

However, third-party platforms such as:

• WordPress;
• WooCommerce;
• hosting providers;
• PHP;
• browsers;
• operating systems;
• payment providers; and
• third-party plugins

may change independently.

PothikTV cannot guarantee permanent compatibility with every third-party product or future version.

38. PRICING

Prices for paid services should be displayed before purchase where reasonably practicable.

Prices may be expressed in Bangladeshi Taka or another supported currency.

Applicable taxes, fees or additional charges should be disclosed where required.

PothikTV may change prices prospectively.

A price change will not ordinarily alter a completed transaction unless required by law or necessary to correct an obvious pricing error in accordance with applicable law.

39. PAYMENTS

PothikTV may support payment through:

• mobile financial services;
• banks;
• cards;
• payment gateways;
• account balances;
• advertising balances; or
• other approved payment methods.

Payment processing may involve third-party providers.

You must not use:

• stolen payment instruments;
• unauthorised accounts;
• fraudulent chargebacks; or
• unlawfully obtained funds.

40. ORDERS

An order may be subject to:

• payment confirmation;
• fraud checks;
• availability;
• licence eligibility;
• technical validation; and
• other reasonable checks.

An automatically generated acknowledgement does not necessarily mean an order has been finally accepted if payment or validation remains incomplete.

41. REFUNDS

Refund eligibility depends on:

• applicable law;
• the nature of the product;
• the Refund Policy;
• whether a digital product has been delivered or activated;
• technical defects;
• duplicate payments;
• misrepresentation;
• service non-delivery; and
• other relevant circumstances.

Nothing in a PothikTV Refund Policy limits statutory consumer rights that cannot lawfully be excluded.

42. DIGITAL PRODUCTS

Because digital products may become accessible immediately after purchase, refund conditions may differ from physical products.

However, PothikTV may provide an appropriate remedy where, for example:

• the purchased file cannot be provided;
• a licence fails due to a verified PothikTV system error;
• the customer is charged more than once for the same transaction;
• the supplied product materially differs from its advertised description; or
• applicable law requires a refund or other remedy.

43. SUBSCRIPTIONS

Some PothikTV services may operate through subscriptions.

Before purchasing a subscription, relevant information should be displayed, including where applicable:

• subscription price;
• billing period;
• included services;
• renewal conditions;
• cancellation conditions; and
• material limitations.

Automatic renewal should operate only where properly disclosed and lawfully authorised.

44. ADVERTISING SERVICES

PothikTV may allow users or businesses to purchase advertising.

Advertisers are responsible for:

• advertisement content;
• claims;
• landing pages;
• products promoted;
• legal permissions;
• intellectual-property rights; and
• regulatory compliance.

Advertisements must not intentionally mislead users.

45. ADVERTISING BALANCE AND FUNDING

Where PothikTV provides an advertising balance, users may add funds using supported payment methods.

Funds credited for advertising are intended for eligible advertising services unless otherwise stated.

Refunds of unused advertising balance may be governed by the Advertising Refund Policy and applicable law.

PothikTV may investigate suspicious funding activity.

46. PROHIBITED ADVERTISEMENTS

PothikTV may reject advertisements involving:

• illegal products;
• fraudulent investments;
• counterfeit goods;
• misleading health claims;
• stolen property;
• malicious software;
• unlawful financial services;
• trafficking or exploitation;
• fake employment;
• deceptive political impersonation;
• prohibited weapons;
• illegal drugs; or
• other unlawful products or services.

Additional advertising rules may apply.

47. REVIEWS AND RATINGS

Where PothikTV provides ratings or reviews, users should base reviews on genuine experiences.

Users must not:

• sell fake reviews;
• publish coordinated fake ratings;
• threaten businesses for compensation;
• impersonate customers; or
• intentionally manipulate rating systems.

PothikTV may remove fraudulent reviews.

48. THIRD-PARTY SERVICES

PothikTV may integrate services provided by third parties, including:

• Google;
• YouTube;
• Vimeo;
• payment gateways;
• hosting providers;
• Firebase;
• analytics services;
• AI providers;
• courier services;
• social media platforms; and
• other external services.

Use of those services may be subject to their own terms.

PothikTV is not responsible for a third-party service’s independent actions outside PothikTV’s reasonable control.

49. EXTERNAL LINKS

PothikTV may contain links to external websites.

A link does not necessarily mean PothikTV:

• owns the external website;
• endorses everything on it; or
• guarantees its security.

Users should independently evaluate external websites before providing sensitive information or making payments.

50. MODERATION

PothikTV may use human and automated moderation to protect the platform.

Depending on the circumstances, PothikTV may:

• warn a user;
• limit visibility;
• remove content;
• restrict features;
• temporarily suspend an account;
• revoke verification;
• restrict monetisation;
• reject advertisements;
• cancel fraudulent transactions; or
• terminate an account.

Actions should be proportionate to the nature and severity of the issue where reasonably practicable.

51. REPORTING CONTENT

Users may report content or accounts believed to violate:

• law;
• these Terms;
• Community Standards;
• copyright;
• privacy rights;
• platform safety rules; or
• other applicable policies.

Submitting a report does not guarantee removal.

PothikTV may investigate and determine the appropriate response.

52. EMERGENCY AND SAFETY ACTION

PothikTV may take immediate protective action where reasonably necessary to address:

• account compromise;
• active cyberattack;
• serious fraud;
• credible threats;
• child-safety concerns;
• serious platform abuse;
• unlawful access; or
• urgent legal requirements.

53. ACCOUNT SUSPENSION

PothikTV may temporarily suspend an account where there is a reasonable basis to investigate:

• serious Terms violations;
• security incidents;
• fraudulent transactions;
• impersonation;
• hacking;
• abuse;
• repeated intellectual-property violations; or
• legal compliance issues.

Where appropriate and legally permitted, users may be informed of the reason.

54. ACCOUNT TERMINATION

PothikTV may terminate an account for serious or repeated violations.

Termination may affect access to:

• profiles;
• community features;
• messaging;
• courses;
• work services;
• advertising;
• software licences;
• purchases; or
• other services.

Rights relating to already purchased products or legally required records will be handled according to applicable law and relevant product terms.

55. USER ACCOUNT CLOSURE

Users may request account closure through available account or support mechanisms.

Account closure is subject to the Privacy Policy and applicable law concerning:

• transaction records;
• legal records;
• published journalism;
• security records;
• licence records; and
• other information that must legitimately be retained.

56. APPEALS

Where PothikTV provides an appeal process, users may request review of certain moderation or account decisions.

Repeated abusive or fraudulent appeals may be restricted.

57. PRIVACY

PothikTV’s collection and use of personal information are governed by the PothikTV Privacy Policy.

By using PothikTV, you acknowledge that personal information may be processed as described in that Policy and applicable law.

58. DATA SECURITY

PothikTV seeks to use reasonable technical and organisational measures to protect user information and platform systems.

However, no Internet service can guarantee absolute security.

Users must take reasonable measures to secure their own accounts.

59. SERVICE AVAILABILITY

PothikTV seeks to maintain reliable services but does not guarantee uninterrupted availability.

Services may temporarily become unavailable because of:

• maintenance;
• hosting failures;
• software updates;
• cyberattacks;
• third-party failures;
• Internet outages;
• natural disasters;
• regulatory action;
• emergency maintenance; or
• circumstances outside reasonable control.

60. SERVICE CHANGES

PothikTV may modify services to:

• improve functionality;
• increase security;
• comply with law;
• improve performance;
• respond to technology changes;
• retire outdated functionality; or
• introduce new services.

Where a change materially affects a paid service, PothikTV should provide reasonable notice where appropriate and practicable.

61. BETA AND EXPERIMENTAL FEATURES

Some PothikTV services may be identified as:

• Beta;
• Preview;
• Experimental; or
• Early Access.

Such services may contain errors, change significantly or be discontinued.

Users should not rely on experimental features for critical operations without appropriate backups.

62. BACKUPS

PothikTV may maintain system backups for security and continuity.

Users remain responsible for maintaining independent copies of important content where appropriate.

PothikTV should not be treated as the sole permanent storage system for critical files unless explicitly stated.

63. NO GUARANTEE OF RESULTS

PothikTV does not guarantee:

• employment;
• income;
• advertising results;
• audience growth;
• search-engine rankings;
• course outcomes;
• business profits;
• publication;
• social-media reach;
• software compatibility with every external system; or
• specific results from AI tools.

64. WARRANTIES

PothikTV will seek to provide services with reasonable care and skill.

Except for rights or warranties that cannot lawfully be excluded, services may otherwise be provided on an “as available” basis.

Nothing in these Terms excludes mandatory warranties or consumer protections available under applicable law.

65. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, PothikTV will not be responsible for indirect or consequential losses arising solely from matters outside PothikTV’s reasonable control.

Any limitation in these Terms is subject to mandatory consumer rights and other rights that cannot lawfully be excluded or limited.

Nothing in these Terms excludes liability where exclusion would be unlawful.

66. USER RESPONSIBILITY

You are responsible for losses or consequences resulting from your own:

• unlawful content;
• fraudulent conduct;
• infringement;
• unauthorised transactions;
• intentional security violations; or
• material violation of these Terms,

subject to applicable law.

67. INDEMNITY

To the extent permitted by law, a commercial or professional user may be responsible for reasonable losses, claims or expenses suffered by PothikTV resulting directly from that user’s unlawful conduct, infringement or material breach of these Terms.

This provision does not remove mandatory consumer rights.

68. FORCE MAJEURE

PothikTV will not be responsible for delays or failures caused by circumstances beyond reasonable control, including:

• natural disasters;
• severe network outages;
• war;
• civil disruption;
• government restrictions;
• nationwide Internet disruption;
• major infrastructure failure;
• third-party cloud outages; or
• other extraordinary events.

This does not affect rights that applicable law requires PothikTV to provide.

69. LEGAL REQUESTS

PothikTV may comply with valid legal requests, court orders and lawful directions from competent authorities.

Where legally permitted, PothikTV may evaluate the scope and validity of requests before disclosing information.

70. GOVERNING LAW

These Terms are governed by the laws of the People’s Republic of Bangladesh, unless mandatory law requires otherwise.

71. DISPUTE RESOLUTION

If a dispute arises, users are encouraged to contact PothikTV first so that the matter can be reviewed and, where possible, resolved informally.

Nothing in this clause prevents a user from exercising statutory consumer rights or filing a complaint with an authority where applicable.

If a dispute cannot be resolved informally, it may be submitted to the court or other competent authority having jurisdiction under the laws of Bangladesh.

72. CONSUMER RIGHTS

Nothing in these Terms is intended to remove or limit consumer rights that cannot lawfully be waived.

Consumers may exercise rights available under applicable Bangladesh consumer protection law.

73. SEVERABILITY

If a court or competent authority finds a provision of these Terms unlawful or unenforceable, that provision will be applied or modified only to the extent permitted by law.

The remaining provisions will continue to apply where legally possible.

74. NO WAIVER

If PothikTV does not immediately enforce a provision of these Terms, that does not automatically mean PothikTV has waived the right to enforce it later.

75. TRANSFER OF SERVICES

PothikTV may reorganise, restructure or transfer a service or related rights and obligations to a lawful successor, affiliate or acquiring entity, subject to applicable law and privacy obligations.

Users will be notified where legally required.

76. CHANGES TO THESE TERMS

PothikTV may update these Terms because of:

• changes in law;
• new features;
• security changes;
• business changes;
• technology changes; or
• regulatory requirements.

The updated version will display a revised “Last Updated” date.

Where changes materially affect user rights or paid services, PothikTV may provide additional notice where required or reasonably appropriate.

Continued use after legally effective changes may constitute acceptance where permitted by law.

Where separate consent is legally required, PothikTV will seek such consent.

77. LANGUAGE

PothikTV may provide these Terms in multiple languages.

Where an official English or Bengali version is designated by PothikTV, that designated version will govern to the extent permitted by applicable law if translations differ.

Mandatory provisions of Bangladesh law will always prevail.

78. ELECTRONIC COMMUNICATIONS

By creating an account, you agree that PothikTV may send electronic communications reasonably necessary for providing services, including:

• account messages;
• verification messages;
• security alerts;
• purchase confirmations;
• invoices;
• licence information;
• application updates;
• course notices;
• legal notices; and
• service announcements.

Marketing communications may be subject to separate preference controls.

79. ENTIRE AGREEMENT

These Terms, together with applicable PothikTV policies and service-specific terms, constitute the agreement governing your use of the relevant PothikTV service.

A separate written contract signed by PothikTV and a user or institution may override these Terms for matters specifically covered by that contract.
